The inclusionary and exclusionary rule are both captured under section 1 of the Evidence Act, 2011. The inclusionary rule simply provides that evidence in any suit or proceeding may be given of every fact in issue and of such other facts which are relevant to the fact in issue. The exclusionary rule excludes the admissibility of evidence which ordinarily is relevant but excluded on grounds of being too remote to be material to the fact in issue, and that the person is not enabled to give evidence of a fact which he is disentitled to prove by any provision of the law.
