KEKERE-EKUN JCA (Delivering the Lead Judgment): The appellant herein as plaintiff instituted an action against the 1st respondent as defendant at the Kano State High Court by a writ of summons dated 30/7/99. The particulars of claim as endorsed on the writ of summons at page 2 of the printed record are as follows : “The defendant purports to carry out business as a dentist at Tahir Dental Centre at Tukur road, Nassarawa Quarters,Kano. Unknown tothe plaintiff, the defendant is not a registered dentist with the Nigerian Medical Council and therefore not licensed to practice dentistry in Nigeria. On or about the 15th day of June, 1998, the plaintiff called at the defendant’s Dental Centre and was attended to by the defendant. The defendant havinglistenedto the plaintiff’s complaint informed the plaintiff that some of her teeth will be extracted and some of them trimmed to enable the fitting of a permanent denture. He claimedthat he would have to fit in a dental crown on the canine teet…
