ADEKEYE, JCA (Delivering the Lead Judgment): This is an appeal by the 1st - 3rd defendants before the trial court against the judgment of the High Court of Oyo State, Ibadan Judicial Division delivered on 7th of February, 1992. The plaintiff at the trial court was Mrs. V. O. Popoola, who claimed against the defendants, Chief S. A. Adewusi, Squadron Leader A.

Adeyemi, Dr. O. Olutogun and the Property Development Corporation of Oyo State as follows:-

Declaration that the plaintiff is entitled to possession of all that piece or parcel of land situate, lying and being at plot A91; No. I Adeyi Avenue, Bodija Estate, Ibadan.

Two hundred and fifty thousand naira (N250.000.00) being damages for continuing trespass being committed on the said land by the defendant.

Injunction restraining the defendants, their agents, servants , or any person claiming through them from entering the said land.

Parties filed and exchanged pleadings in accordance with High Court (Civil Procedure) Rules of Oyo State 198…
