JAMES GAMBO ABUNDAGA, J.C.A. (Delivering the Leading Judgment): The judgment upon which this appeal is predicated had as its origin, an amended information, dated 27th May, 2015 preferred against the defendant (now appellant) before the High Court of Lagos State, holden at Lagos in charge No. ID/823C/14 by the prosecution (Respondent).

The two counts of the charge are as follows:

1ST COUNT

Stealing contrary to Section 390(9) of the Criminal Code, Cap C17 Vol. 2 Laws of Lagos State of Nigeria, 2003.

PARTICULARS OF OFFENCE

​Anthony Ngozi Okwudimonye on or about the 6th day of April 2009 at Lagos within the jurisdiction of this Court with intent to defraud, fraudulently converted to your personal use four (4) Toyota Prado Jeeps and one (1) Toyota Hilux all valued USD 139,500 (One Hundred and Thirty Nine Thousand, Five Hundred United States Dollars) property of X-Com General Trading LLC, based in Dubai United Arab Emirates.
