SALAMI JCA (Delivering the Lead Judgment): On 14 April 2007, the Governorship election was held throughout the country. The second and third petitioners were sponsored in Adamawa State by the first petitioner, Action Congress as its candidates for the offices of the Governor and Deputy Governor respectively. The sixth respondent contested for the same office as the candidate of the Peoples’ Democratic Party. The first respondent was the body charged with the responsibility to conduct the election. In exercise of its power, it declared the sixth respondent as the winner of the election and returned him to the office.

Dissatisfied with the declaration, the petitioners filed an election petition before the Governorship and Legislative Houses Election Petition Tribunal, sitting in Yola, Adamawa State of Nigeria, challenging the validity of the election and the return of the sixth respondent on the grounds set out immediately hereunder:
