JUDGEMENT
ABBAN, J.A.: On the 21st October, 2011, the High Court, Accra, delivered a judgment in this case which went against the Defendants (hereinafter called the Appellants). The appellants herein being dissatisfied with the decision of the High Court have appealed against the said judgment to this court.
Now, before addressing the grounds of appeal, we want to capture the history of this case which was presented to the High Court and which has travelled through the said court culminating in this appeal. On 3rd December 2002, the plaintiff (hereinafter referred to as the respondent) instituted an action against the appellant claiming per his amended writ of summons the following reliefs:
