JUDGMENT OF THE COURT

By a Petition dated 11^th December, 2017, Okiya Omtatah Okoiti “the 1^st respondent” petitioned the High Court for various declarations and orders against the Central Bank of Kenya “the 1^st appellant ”, De La Rue International Limited “the 2^nd appellant”, Public Procurement Review Authority, “the 2^nd respondent”, De La Rue Currency and Security Print Ltd “the 3^rd respondent ” and De la Rue Kenya EPZ “the 4^th respondent”. The petition also named the Attorney General, the Director of Public Prosecutions and the Ethics and Anti-Corruption Commission as interested parties and are enjoined in this appeal as the 5^th, 6^th and 7^th respondents respectively. The petition alleged contravention of Articles 27, 35 and 47 of the Constitution and the national values and principles of governance set out in Articles 1, 2, 3, 10, 231 (3), 232 and 259 (1) of the Constitution by the appellants and in particular the 1^st appellant.
