JUDGMENT 

[1] By their Amended Writ of Summons and Statement of Claim, the Plaintiffs, Rhoda Aku  Cudjoe and Isaac Kpakpo Acquaye, claimed against the Defendants, Comfort Acquaye  and Solomon Kpakpo Acquaye the following reliefs; 

i. An order for recovery of possession of portions of the Plaintiff’s land at Osu,  Accra, devised to them under the last will and testament of their late father  Emmanuel Adotey Acquaye which properties the Defendants have trespassed  upon and built unauthorized structures. 

ii. General Damages for trespass

iii. An order for the demolition and/or removal of the unauthorized structures  constructed by the Defendants on the Plaintiff’s land at Osu, Accra 

iv. An order of perpetual injunction restraining each of the Defendants whether by  themselves, their servants, agents or assigns from entering, building upon or  disturbing the Plaintiff’s ownership and possession of their lands at Osu, Accra.
