ADEKEYE JCA (Delivering the Lead Judgment): This is an appeal against the interlocutory decision of the High Court of Justice Kwara State, Ilorin Judicial Division read on 9 November 2006, and the final judgment of the same court delivered on 3 August 2007.

The claims of the plaintiff, now respondent in this appeal before the High Court as adumbrated in her statement of claim, are as follows:

“(1) A declaration that the defendant’s act of paying the said sum of $4,200 US Dollars to another person contrary to the instruction of Ivona Williams was negligent and wrongful.

(2) A declaration that the failure/refusal of the defendant to pay to the claimant the sum of $4,200 US Dollars or the naira value thereof properly sent to the claimant from Belgium by her friend, by name Ivona Williams via Western Union Money Transfer through the defendant to the claimant is wrongful and unlawful.
