ADEKEYE JCA (DELIVERING THE LEADING JUDGMENT): This is an appeal against the ruling of the High Court of Oyo State, Ibadan Judicial Division delivered on the 10th of May, 2002. The facts of the case before the lower court were that the plaintiff - the Attorney-General of Oyo State claimed against the defendants Nigerian Labour Congress Oyo State Chapter, Ibrahim Bolomope, Bashiru Lawal, Remi Adedeji and Alhaji Sabitu Dito for themselves and on behalf of other members of the Nigerian Labour Congress, Oyo State Chapter and the civil servants in Oyo State as follows -
1) Declaration that no trade dispute known to law has been declared by the defendants
2) Declaration that prescriptions in parts I and II of Trade Disputes Act, Laws of the Federation of Nigeria, 1990 (as amended) are conditions precedent to the declaration of a trade dispute by the defendants.
