Can a non owner of a property make a valid complain to the police of its damage?

A person in possession of property may maintain an action against any other person except one who has actual title to land. (Majolagbe v. Larbi [1959] GLR 190-195). It therefore stands to reason that they would be able to institute a criminal prosecution as well.

Moreover, Sections 172-175 under the Criminal Code (Act 29) regarding unlawful damage do not mention the title of the complainant as an element of the offence of unlawful damage.
