Can a party who was given an opportunity to be heard by the court but failed to utilize it later claim that he or she was not given a hearing?

It depends on the type of opportunity given and whether it even qualifies as an opportunity to be heard. However if if the party failed to use that opportunity, it would be contested by the opposing side.
