When money has been paid into a frozen account by a victim of fraud, such a victim can maintain an action against the fraudster for deceit, seeking the remedy of damages because the act leading to fraud is one that is both a criminal offense according to section 419 of the criminal code Act, and a civil wrong. As much as the EFCC are taking steps to deal with the fraudster, it is also within the right of the victim to sue under civil law for damages which is monetary compensation for the injuries he has suffered.
