The court will consider many factors inclusive but not limited to

1. The domicile of the parties - the permanent home of the parties (the court may also consider citizenship)

2. Where the party(s) stayed when a certain event or activity occurred

3. Consent from the parties

4. What is fair / just

5. Discretionary power of the courts

once the court determines that it has jurisdiction, it will then determine which law(s) are applicable.
