GABRIEL OMONIYI KOLAWOLE, J.C.A. (Delivering the Leading Judgment): The High Court of Oyo State, sitting in Ibadan, Coram: Bolaji, J., “the lower Court”, delivered its ruling in the Suit No: 1/940/14 on 28th July, 2015, wherein it entered judgment summarily in favour of the Respondents, who were the Claimants in the suit.
The Appellant, as the Defendant in the lower Court, was aggrieved by the said judgment and had instituted the instant appeal vide the Notice of Appeal, dated 29thJuly, 2015. The said notice of appeal, having four (4) grounds upon which the appeal was premised, is reproduced in pages 219-223 of the record of appeal, “the record”.
