MODUPE FASANMI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the ruling of the Ogun State High Court of Justice in Suit No. MT/3/2012 delivered on the 2nd of July 2012.

Briefly, the Respondents filed an application at the lower Court on the 14th of February 2012 praying the Court for the following orders:

1. AN ORDER extending the time which the Claimants/Applicants may apply for leave to seek issuance of Writ of Possession to enforce/execute the judgment of this Honourable Court delivered on Friday 11th May, 1973 in Suit No. AB/24A/71.

2. AN ORDER granting leave to the claimants to apply for Writ of Possession enforce/execute the judgment of this Honourable Court delivered on Friday 11th May, 1973.

3. AND FOR SUCH FURTHER ORDER or other orders as the Honourable Court may deem fit or proper to make in the circumstances.
