MUHAMMED LAWAL SHUAIBU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Federal High Court sitting in Calabar, Coram Hon. Justice S. A. Amobeda delivered on 24th March, 2020 in which the preliminary objection of the 1st respondent was upheld and the appellant’s originating processes were struck out for want of jurisdiction.
By originating summons brought pursuant to Order 2 Rule 2 of the Fundamental Rights Enforcement Procedure Rules, 2009 and Section 34(1) (a), 35 (a), 36 (1) (2) (a) (b), 37 and 42 (1) of the Constitution of the Federal Republic of Nigeria, 1999 as amended, the applicant sought for the determination of the following questions:-
