The Accused Person/Appellant herein was jointly charged with another person with the offences of conspiracy to commit robbery and robbery and were arraigned before the High Court, Accra as 1st and 2nd Accused Person respectively. The two Accused Persons were jointly charged with two counts of offences namely: conspiracy to commit robbery contrary to section 23(1) and 149 of the Criminal Offences Act, 1960 (Act 29); and robbery contrary to section 149 of the Criminal Offences Act, 1960 (Act 29). The matter proceeded to trial after which the 2nd Accused was convicted of both counts of conspiracy to commit robbery and robbery. The Appellant was convicted of the offence of conspiracy to commit robbery and acquitted for robbery. The trial High Court sentenced both Accused Persons to ten years imprisonment for the offence of conspiracy to commit robbery contrary to section 23 of the Criminal Offences Act, 1960 (Act 29).
