EMMANUEL AKOMAYE AGIM, J.S.C. (Delivering the Leading Judgment): This appeal No. SC/1311/2018 was commenced on 17-8-2018 when the appellant herein filed a notice of appeal against the judgment of the Court of Appeal delivered on 20-7-2018 in Appeal No. CA/J/11/C/2017 setting aside the judgment of the High Court of Bauchi State delivered on 8-8-2016 in Criminal case No. BA/07C/2013 that discharged and acquitted the appellant of the commission of the offences of conspiracy to commit culpable homicide punishable with death and culpable homicide punishable with death. The Court of Appeal rather convicted him of the said offences and sentenced him to death by hanging on the neck. The notice of appeal contains 7 grounds for the appeal.

Both sides filed, exchanged and adopted their respective briefs as follows - appellant's brief, respondent's brief and the appellant's reply brief.
