JAMES S. ABIRIYI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment delivered on 14th March, 2019 in the High Court of Adamawa State holden at Yola. The Appellant was the Plaintiff in the High Court (the Court below). The Respondents were the Defendants. The Appellant claimed title to the land in dispute among other reliefs on the following facts: According to the Appellant, he bought the land in dispute from Alhaji Gidado Ibrahim who was the original grantor. Alhaji Gidado Ibrahim was allocated the land by the Adamawa State Government. Alhaji Gidado Ibrahim handed over the original title documents to him.
The 1st Respondent trespassed into the land claiming that it was his own. He reported the 1st Respondent to the 2nd Respondent.
In defence, the 1st Respondent said that he purchased the land on 27th November, 2016 from Mr. Dio D. Denis and obtained a building permit on 6th December, 2016. After fencing the land in dispute, the appellant approached him cl…
