This is an interlocutory appeal by the Defendant/Applicant/Appellant (who shall hereafter be referred to simply as the Defendant) to set aside the ruling of the Circuit Court, Tema, dated 23rd March 2020 in an action commenced by Plaintiff/ Respondent/Respondent (who shall hereafter also be referred to simply as the Plaintiff).

The brief facts of this case are that the Plaintiff on 5th July 2012 filed a writ in the Circuit Court, Tema against the Defendant for a declaration of title to land at Klangon, special damages of GH¢4,406.00, general damages for trespass and recovery of the disputed land. He claimed he had acquired the land in or about 2009 from Nii Anum Keteke Akwalo I, Head of Numo Atta Tetteh Tawiafio Family of Tema Newtown for valuable consideration.
