GUMEL JCA (Delivering the Lead Judgment): This is an appeal against the judgment of Lagos State High Court, in suit No. ID/151M/2013, delivered on 17 October 2014, per Onyeabo, J.

The appellants were the applicants at the High Court (court below). The 1st and 2nd appellants were minors and female muslim students of Atunrashe Junior High School, Surulere, Lagos State , a public school owned and managed by the 1st respondent. The 3rd appellant is an incorporated trustee under part of the Companies and Allied Matters Act, Laws of Federation of Nigeria, 2004. It was established with the main objective of promoting the welfare of muslim students and propagation of Islamic tenets in Nigeria. The 1st and 2nd appellants who were each 12 years A old, commenced this action for the enforcement of their fundamental human rights, through their respective parents as their next friends.
