MUHAMMAD, J.C.A. (Delivering the Leading Judgment): At the Ilorin High Court of Justice (lower court), the respondents herein, took a writ of summons on behalf of themselves and the entire descendants of Aliyu Uthman. the 1st Balogun Ajikobi, Ilorin, against the appellants. The endorsed claims read as follows:

"1.A declaration that the publication of a book titled ShaykhMuhammed AI-Adabiyy to the extent of its analysis contained at page 57 thereof and the illustration of past, present and people entitled to be appointed Balogun Ajikobi excluding the entire family of the plaintiffs who are descendants of Uthman the 1st Balogun Ajikobi of Ilorin is false, incorrect, misleading, malicious and unfounded.

2.A declaration that the plaintiffs have been libeled as a result of the said publication and their family origin, legitimacy and reputation rendered in doubt.

3.The sum of One Million Naira only as general damages against the defendants jointly and severally as a result of the publication.
