ADAMU JCA (Delivering the Lead Judgment): The appellant and two other persons were jointly arraigned before the High Court of Lagos State (Ikeja Judicial Division) on an information filed in 1982, containing two counts for the offences of conspiracy to commit robbery and armed robbery, contrary to sections 403(A) and 402(2)(a) respectively of the Criminal Code Law of Lagos State. They all pleaded not guilty to the counts or charges. During the trial, the prosecution called 2 (two) witnesses namely PW1 (the victim of the offences) and PW2 (the IPO). The appellant and other co-accused persons also testified for themselves (as DWs 1-3). At the end of trial or hearing and after the addresses by the learned counsel appearing for the appellant and other accused persons as well as for the prosecution, the trial court adjourned the case for judgment on 26/4/85.
