ALKALI JCA (Delivering the Lead Judgment): This appeal is against the judgment of Sharia Court of Appeal, Kano, Kano State (hereafter called the lower court), before coram by Hon. Kadi Alhaji Muhammed Umar, Hon. Kadi Alhaji Abubakar Ismalia Kan Karofi, Hon. Kadi Alhaji Tijjani Yahaya Dukawu and Hon. Kadi Alhaji Sani Muazu, in suit No. SCA/CV/ 59/2006, delivered on 19 August 2008, affirming the judgment of Upper Sharia Court Rijiyar Lemo Kano.

The facts leading to this appeal are that on 31 March 2003, the second respondent herein, on her behalf, and on behalf of other respondents, instituted this action against Alh. Abbas Abdullahi and Haj. Maryam Abdullahi, brother and sister of Alh. Sadiq Abdullahi, her deceased husband before the Upper Sharia Court, Bampai sitting at ‘Yankaba. The case was later transferred to the Upper Sharia Court Rijiyar Lemo (hereafter called the trial court). In her statement of claim, she stated:
