JUDGMENT

The plaintiff issued out Writ of Summons against the defendant on 26th March, 2009 for the following reliefs:

1. a declaration that plaintiff’s appointment was wrongfully terminated;

2. three month’s salary for each year plaintiff has served as an employee of the defendant company and any other outstanding benefits as per the collective bargaining agreement;

3. damages for wrongful termination of his appointment; and

4. costs.

The defendant entered appearance on 15th May, 2009 and went on to file his Statement of Defence on 26th May, 2009.

After pleadings had closed, the Court set down the following issues for trial on 19th August, 2009:

a. Whether or not plaintiff’s employment was wrongly terminated;

b. Whether or not plaintiff is entitled to his claim; and

c. Any other issues arising out of the pleadings.

Plaintiff’s case is that he was employed by the defendant on 12th December, 1994 and his appointment was terminated on 16th September, 2008. He, therefore, worked with the defendant …
