TANI YUSUF HASSAN, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of Rivers State High Court delivered on the 13th day of April, 2017 by Honourable Justice E. Teetito in Suit No: PHC/1885/2005.
By an Amended Writ of Summons and Amended Statement of Claim dated and filed on the 18th of July, 2008, the Appellants as Plaintiffs claim against the Defendant (Respondent herein) as follows:

A declaration that the 1st Claimant has acquired equitable interest in the plot of land described as plot A20 Diobu, GRA phase III and covered by certificate of occupancy No. 65 shown on Plan No. P 909 (tracing No. RS.3189), and that the Defendant, holds no interest or title whatsoever in the said land covered by the said certificate of occupancy.
