AKA'AHS, J.C.A. (Delivering the Leading Ruling): The applicant who was the plaintiff in Suit No. B/622/96 brought this application pursuant to section 242(1) of the Constitution of the Federal Republic of Nigeria 1999 and Order 3 rule 4 of the Court of Appeal Rules 1981 (as amended) seeking the following reliefs:

(a)An order granting the plaintiff/appellant/ applicant an extension of time within which to seek leave to appeal against the order made by the High Court of Edo State in Suit No. B/622/96 on 12th November, 1999 dismissing the plaintiff/appellant/applicant's suit for want of diligent prosecution;

(b)An order granting the plaintiff/appellant/applicant leave to appeal against the aforesaid order of the High Court of Edo State made on 12th November, 1999;

(c)Extension of time within which to file the plaintiff/ appellant/applicant's notice of appeal against the aforesaid order of the High Court of Edo State made in Suit No. B/622/96 on 12th November, 1999.
