AKPABIO, JCA (Delivering the Lead Judgment): This was an ex-parte motion brought pursuant to section 16 of Court of Appeal Act, 1976 and inherent jurisdiction on behalf of the Applicant for the following orders of this Court.

(1) An order joining:

(i) Danlami Ali;

(ii) Col. Audu Tobasheen Ibrahim and

(iii) The Sheriff, High Court of Justice, Wukari as co-respondents in the motion No. CA/J/194m/99, who will be affected by the Orders of this Court in Motion Scheduled for hearing on 20/3/2000.

(2) An order that all processes of this court, and in particular motions dated 21st July, 1999 and 1st December, 1999 be served on the Danlami and Col. A.T. Ibrahim by delivering the same to the Sheriff High Court, Taraba State, Wukari.

AND for such further or other order as this Honourable Court may deem fit to make in the circumstances.

TAKE FURTHER NOTICE that at the hearing of this application, the applicant shall refer to motion on notice dated 21st July, 1999 and 1st December, 1999.”
