ABDU DOGO, J.C.A. (Delivering the Lead Judgment): This appeal is against the whole decision/judgment of the Kwara State High Court, Ilorin Judicial Division (the lower Court) in Suit No: KWS/106C/2022 delivered on 30th November 2023 by A. O. Akinpelu, J.

BACKGROUND FACTS

The Appellant was tried along with two other Defendants by the lower Court for the offences of criminal conspiracy to kidnap and kidnapping of one Abubakar Ahmadu (Abu), on or about the 21st day of July, 2022 at Geri Alimi, Ilorin, Kwara State, contrary to Sections 2 and 1 of Prohibition of Kidnapping law, Laws of Kwara State, 2010 respectively and punishable under Section 15 of the same law. The Appellant and the other two Defendants all pleaded not guilty to the two counts of the amended charge dated and filed on the 30th day of November, 2022.
