EMMANUEL AKOMAYE AGIM, J.S.C. (Delivering the Lead Judgment): This Appeal No. SC/CR/847/2020 is against the judgment of the Court of Appeal delivered on 28-8-2020 in Appeal No. CA/K/385A/C/2019 dismissing the said appeal against the judgment of the High Court of Kano State delivered on 1-2-2018 in Charge No. JDU/63C/2016 convicting the appellant with others for conspiracy and culpable homicide punishable with death, sentencing each of them to death by hanging. 

Both sides have filed, exchanged and adopted their respective briefs as follows- appellant's brief, respondent's brief and appellant's reply brief. 

The appellant's brief raised three issues for determination as follows: 

1. "Whether the trial Court and the lower Court had jurisdiction, the whole trial being a nullity, fresh plea not having been taken or extracted from the Appellant after the trial Court amended the charge no: JDU/63C/2016? Distilled from group five of the Appellant's Notice of appeal).
