IBIYEYE JCA (Delivering the Lead Judgment): This appeal is from the judgment of the Abeokuta Judicial Division of the Ogun State High Court of Justice delivered by Popoola J. on the 20th of March, 2001.
The plaintiff now the appellant as per paragraph 18 of his statement of claim sought the following reliefs against the defendant now the respondent:
“1. A declaration that the purported termination of the appointmentof the plaintiff’s service as a public relations officer from the service of the defendant is invalid, illegal, ultra vires , null and void and of no effect.
A sum of N931,428.92 being damages suffered by the plaintiff as a result of the unlawful and wrongful termination of his appointment from the service of the defendant as per the defendant’s letters of 10th April, 1988 and 30th March, 1989.
An order reinstating the plaintiff in the public relations department of the defendant’s council.
