OKUNOLA JCA (Delivering the Lead Judgment): This is an appeal against the decision of Sofolahan J of the High Court of Ogun State, holden at Abeokuta, delivered on 15th May, 1992 wherein the application of the applicant/appellant was refused.
The facts of this case briefly put were as follows:
The appellant herein who was the Chairman of Ifo Local Government in Ogun State, was impeached on 6th May, 1992 by an Investigation Panel, namely, Ifo Local Government Impeachment Panel (hereinafter called the Panel), constituted by the Honourable Chief Judge of Ogun State, following notice of allegation of gross misconduct served on him. The appellant by an application made ex-parte dated 7th May, 1992 sought for leave to apply for an order of certiorari directed against the Chairman and Members of the Panel.
