PETER OLABISI IGE, JCA (Delivering the Leading Judgement): This appeal is against the Judgment of the High Court of the Federal Capital Territory, Abuja, Coram: O. A. Adeniyi, J., delivered on 9th day of July, 2013.

The Appellant herein as the Plaintiff via a Writ of Summons and Statement of Claim filed on 19th September, 2011, and an Amended Statement of Claim subsequently filed on the 16th July, 2012, with the Leave of Court, claimed against the Defendant now Respondent the following reliefs:

1. Vacant possession of a duplex with appurtenances thereof situate at Plot No. 1392, Justice Mamman Nasir Street, Asokoro, Abuja.

2. Arrears of rent in the sum of N4,200,000.00 (Four Million, Two Hundred Thousand Naira) only, being 1 year rent commencing from 4th September, 2010 - 3rd September, 2011, inclusive of 5% Management Fee.

3. Mesne Profit at the rate of N350,000.00 (Three Hundred and Fifty Thousand Naira) only, per month from 4th September, 2011 until vacant possession is given up.
