PAUL OBI ELECHI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Ekiti State High Court of Justice, Ikere Ekiti Judicial Division delivered by Hon. Justice A.A. Adeleye dated the 12th day of November, 2015 whereby the Court entered judgment in favour of the respondent against the appellant.
FACTS OF THE CASE
The respondent who was the claimant at the lower Court filed the action in her personal capacity. Her case in a nutshell is that a parcel of land situate at upper Oke Osun, opposite Amoye Grammar School, along Akure road, Ikere Ekiti measuring approximately 200 ft (feet) by 110 ft (feet) belongs to her on the ground that she bought it from ELPC, Ikere Ekiti on 21st day of January, 1995. The respondent later said she contributed a greater percentage to the purchase price and being a submissive wife, she gave her nod to the receipt evidencing payment to be made in her husbands name.
