ADEBUKUNOLA ADEOTI BANJОКО, JCA (Delivering the Leading Judgment): This Appeal is against the Judgment delivered by Honorable Justice OLANREWAJU MABEKOJE of the Ogun State High Court, Abeokuta Division, on the 14th Day of January, 2013 in Suit No AB/152/2011, contained at Pages 139-152 of the Record of Appeal filed on the 7th day of May, 2013.

The Brief facts of the Case that gave rise to this Appeal were that on the 5th of September 2007, the 1st Appellant was appointed as the Executive Chairman of the Ogun State Universal Basic Education Board, (hereinafter referred to as SUBEB) by the Ogun State Government, Otunba Gbenga Daniel, the Erstwhile Governor of Ogun State. The 2nd - 4th Appellant were equally so appointed, as Members of the Board. Their Tenure were to run for Four(4) years, which was subject to re-appointment upon expiration.
