TSAMMANI, J.S.C. (Delivering the Leading Judgment): This appeal is against the judgment of the Court of Appeal, Lagos Division delivered on the 19th day of June, 2012 in Appeal No.CA/1/848/2009.
By a writ of summons and statement of claim filed on the 08/8/2008, the 1st respondent who was the plaintiff sought the following reliefs:
A Declaration that by the continued effect of the lease agreement dated 29th September, 1983 between the plaintiff and the 1st defendant and as novated by the special clauses contained in the Certificate of Occupancy number 90/90/37, the lease agreement between the plaintiff and the 1st defendant is still valid, legal and subsisting.
A Declaration that the properly at 2A, Osborne Road, Ikoyi, Lagos, and every other property covered by the said lease agreement dated 29th September, 1983 and novated by special clauses contained in the Certificate of Occupancy number 90/90/37 is validly and legally acquired by the plaintiff.
