SAULAWA JCA (Delivering the Lead Judgment): The present appeal is against theinterlocutory ruling of the Lagos StateHigh Court, Ikeja Judicial Division, holden at Ikeja, which was delivered on 8 May 1998 by the Hon. Justice Adebayo Manuwe, thereby dismissing the appellant’s suit in limine . It is discernible from the record of appeal that the appellant had instituted a suit (No. ID/81/96), vide a writ of summons in the court below, A on 1 January 1996, against the respondent. By virtue of the statement of claim thereof, filed on 2 February 1996, the appellant sought the following reliefs against the respondent: A declaration that the plaintiff is entitled to a statutory right of occupancy of a piece of land known as plot No. 10, block E in B the L.A.
