OGEBE JCA (Delivering the Lead Judgment): The plaintiffs before the lower court namely the 2 (two) appellants before this court who were Speaker and Deputy Speaker respectively of the Oyo State House of Assembly and Oyo State House of Assembly which is now plaintiff/respondent to this appeal commenced their claim by an originating summons before the High Court of Oyo State on the 23rd of December, 2005 seeking the following declarations and reliefs.

“Having regard to the clear provisions of the 1999 Constitution, with particular reference to the powers conferred on the Oyo State House of Assembly to wit; initiate and carry out impeachment proceedings against the Governor or the Deputy Governor of a State and particularly section 188(1), (2), (3), (4) and (5) thereof of the 1999 Constitution of the Federal Republic of Nigeria is not to be read in isolation and complete exclusion of other sections of the Constitution relating to the legislative powers of the House of Assembly.
