OKUNOLA, JCA: (Delivering the Lead Ruling): This is an application dated and filed on 28 September, 2001; following the delivery of the judgment of this court on 12th July, 2001. By this application, the applicant is seeking for:

“AN ORDER setting aside the consequential orders or reliefs granted by this Honourable court in its judgment delivered on 12th July, 2001 same being a nullity; having been made without jurisdiction.”

PARTICULARS

The appellant as an employee of NEPA(the respondent ) is a public servant in the public service of the Federal Republic of Nigeria.

NEPA is a creation of statutes via Decree No. 24 of 1972 and also Cap. 256 Laws of the Federation of Nigeria, 1990. A NEPA (the respondent) is a statutory corporation.

The appellant, as a public servant has a pensionable appointment which enures until he is 55 years of age before retirement.

There was no relief claimed by any of the parties touching on the consequential orders made by the court.
