 THERESA NGOLIKA ORJI-ABADUA, P.J.C.A.(Delivering the leading judgment).The Appellant and one Ayobami Ojo were arraigned before the Ekiti State High Court sitting at Ado Ekiti on the 16th February, 2017 on a three Count Information of Conspiracy to commit armed robbery contrary to section 6(b) of the Robbery and Firearms (Special Provisions) Act, Cap. R11, Laws of the Federation. Count Two-armed robbery in that they robbed one Amire Adefunke of her Nokia Phone and they were armed with offensive weapon to wit pistol contrary to section 1(2) of the Robbery and Firearms (Special Provisions) Act, Cap. R11, Laws of the Federation of Nigeria, 2004. Thirdly, Being in possession of firearms contrary to section 3 of the Robbery and Firearms (Special Provisions) Act, Cao R11, Laws of the Federation, 2004, in that they were found in possession of locally made pistol and a cartridge. At the end of the trial, the lower Court discharged the 1st defendant pursuant to section 30 of the Criminal Code …
