OMAGE, JCA (Delivering the Lead Judgment): This appeal is filed by Mr. Peter Adeosun and Mr. Olufemi Alebiowu against who the Oyo State High Court gave judgment in suit No.l/1037/94. The judgment was delivered on 30th June 1999. In the judgment, the learned trial court found proved the averments in the plaintiff’s claim and ordered as follows:

“I award the sum of N150,000 in favour of the plaintiff against each of the defendant jointly and severally being general damages for libelous advertisement headed “Disclaimer” contained at page 14 of the issue of Daily Sketch of Monday the 14th day of February 1994 paid for by the 1st and 2nd defendants.”

The disclaimer is headed thus, and contains the following:

“This is to inform all members of the Nigerian Association of Patent and Proprietary Medicine Dealer (NAPMEED) and the general public that Alhaji Tajudeen Afolabi, whose photograph appears below and the following persons.
