IBIYEYE, J.C.A. (Delivering the Leading Judgment): Three candidates namely: Mr. G. A. Adepoju, Chief and Folorunso Awoduyilemi and Dr. Samuel Oyebade contested for the office of The Chairman of the Ondo East Local Government at the Local Government elections which took place throughout Nigeria on the 5th day of December, 1998. Mr. G. A. Adepoju and Chief F. Awoduyilemi who are the 1st appellant and the respondent in this appeal were respectively sponsored by Alliance for Democracy (otherwise referred to as AD) and Peoples Democratic Party (otherwise referred to as PDP) while Dr. Samuel Oyebade who apparently is not a party to this appeal contested on the platform of the All Peoples Party (otherwise known as APP).
