MUHAMMAD, J.C.A.: (Delivering the Leading Judgment):- This appeal emanated from the interlocutory injunction granted on the 28th day of July, 1995 by a Kwara State High Court sitting at Offa. After the settlement of pleadings and before the commencement of hearing, the 1st respondent as plaintiff/applicant in Suit No.KWS/OF/21/94, filed before the lower court an application asking for orders of interlocutory injunction restraining the 1st defendant either by himself, his servants, agents or privies from:

"(a) Committing further acts of trespass to wit: erect any new structure or building, farm, enter or do any other thing on plaintiff's family land,

(b)Disturbing, interfering or disallowing the plaintiff's familymembers, their agents, servants or privies from continuing with the building of the family Mosque and farming on their family land, pending the determination of the substantive suit and for such further or other order(s) this Honourable Court may deem fit to make in the circumst…
