A.AUGIE, J.C.A.:, (Delivering the Leading Judgment): This is an interlocutory appeal against the decision of the High Court, Ota, Ogun State, which dismissed the Appellants' preliminary objection challenging the jurisdiction of the Court to entertain the action instituted by the Respondent, and the locus standi of the Respondent to institute the action. The Respondent's claims as endorsed in the Writ of Summons are as follows-
1. An Order of Perpetual Injunction restraining the Defendants, their agents, privies, workers, servants otherwise howsoever called from trespassing on the piece/parcel of land known as the Eastern part of Plot C21/6 containing an area approximately 3.551 Hectares situate at Agbara Village, Igbesa, Ado-Odo, Local Government Area, of Ogun State more particularly described and delineated in survey plan No. FN6064B and registered as No. 28 at page 28 in volume 421 in the Land Registry at Abeokuta.
