ABUBAKAR SADIQ UMAR, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Lagos State delivered on 6th June, 2011 by O. Atinuke Ipaye, J., wherein the trial Court dismissed the Appellants’ claims on the ground that they were statute barred.

BRIEF FACTS OF THE CASE

The Appellants as claimants commenced the action before the High Court of Lagos State against the Respondents via an originating summons. By leave of Court, the originating summons was subsequently amended. The Appellants before the trial Court claimed for the following reliefs in their amended originating summons:

“1. A declaration that the purported Notice of Acquisition as published and contained in the Lagos State Official Gazette No. 47, Volume 8 of the 20th November 1975 by the Lagos State Government in respect of the land and appurtenances lying and situate at No: 7/9 TINUBU STREET LAGOS otherwise known as JUNCTION PHOENIX LANE, KAKAWA/TINUBU STREET LAGOS and covered by LAND …
