SANUSI, JCA (Delivering the Lead Ruling): The applicants herein filed this motion pursuant to Order 3 rule 8 of the Court of Appeal Rules, section 241 of the Constitution of the Federal Republic of Nigeria, 1999 and under the inherent jurisdiction of this Honourable Court. In the application, the applicants are praying for the undermentioned orders:-
An order compelling the Chief Registrar of the High Court of Lagos State to compile the record of appeal in this case within 30 days from the date of this order; or in the alternative.
For an order that the case be heard de novo by the High Courtof Lagos State so as to restore the appellants’ right of appeal. And for such further or other orders as the Honourable Court may deem fit to make in the circumstances.
