BIOBELE ABRAHAM GEORGEWILL, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment of the High Court of Lagos State, Coram: S. B. A. Candide - Johnson J., in Suit No: Suit No. ID/310/2007: Billaminu Adisa Lawal Adeleke and Ors v. Waidi Liadi and Ors delivered on 27/4/2009, wherein the Appellants' suit against the Respondents was dismissed for being misconceived, not maintainable and amounting to an abuse of Court process.

The Appellants were dissatisfied with the said judgment of the Court below and had promptly appealed against the said judgment vide a notice of appeal filed on 30/4/2009 on five grounds at pages 389-392 of the Record of Appeal. The Record of Appeal was compiled and transmitted to this Court on 7/10/2011 but was deemed as properly transmitted on 11/10/2011. The Amended Appellants' brief was filed on 6/6/2017.
