PETER-ODILI JSC (Delivering the Lead Judgment): This is an appeal from the judgment of the Court of Appeal, Abuja Division delivered on 24 November 2010 dismissing the appellant’s appeal and upholding the sentence and conviction of the trial court. The appellant had been tried and convicted on a two count charge of conspiracy and armed robbery and sentenced to three and five years imprisonment respectively with the sentences to run concurrently. The appellant dissatisfied with the judgment of the trial court appealed to the Court of Appeal or court below for short, which in turn dismissed the appeal and affirmed the conviction and sentence of the court of trial. Further dissatisfied, the appellant appealed to the Supreme Court on four grounds of appeal.
