JUDGMENT
INTRODUCTION
The plaintiff commenced an action by a writ of summons filed on 22nd December 2021, which was later amended on 19th September 2023, claiming the following reliefs:
“1. The payment of the sum of AUD 246,649 being the outstanding balance owed the plaintiff as at 30th April 2016.
2. Interest of 1.5% on the above sum from 30th April 2016 until date of final judgment and thereafter at the prevailing bank rate until date of final payment.
3. Costs”.
PARTIES’ CASE
It is the plaintiff’s case that between June 2013 and November 2014, it supplied the defendant with products on a revolving credit basis. On 2nd January 2015, the defendant made a payment of USD20,000.00 to reduce its indebtedness to it, marking the last payment the defendant made to it. As of 13th January 2015, the defendant was indebted to it in the sum of AUD246,649.00.
